ABISUA TRAVEL GUNA YALA is considered one of the safest agencies in Guna Yala – San Blas.
Please read the following conditions carefully, as they constitute your contract with ABISUA TRAVEL GUNA YALA. By booking a trip with ABISUA TRAVEL GUNA YALA, you agree to be bound by these Terms and Conditions, which describe, among other things, our cancellation policy and certain liability limitations when making your reservation.
Once your reservation is confirmed, you may ask us any questions regarding your trip, and we will be happy to assist. Our prices do not include meals not specified in your itinerary, personal expenses, personal insurance, or luggage handling.
1. The Contract
The contract is between ABISUA TRAVEL GUNA YALA (also known as the Company) and the client, the person traveling or attempting to travel on a tour operated by the Company. By making a reservation by phone, through the website, by email, or by fax, you accept and are bound by these Terms and Conditions. These Terms and Conditions form the entire agreement between the Company and the Client in connection with the subject matter herein and constitute a binding agreement. No prior verbal or written representation, warranty, agreement, guarantee, prior agreement, service description, conditions, or any promise of reimbursement other than what is expressed here applies. The service to be provided is the tour(s) mentioned in the booking confirmation.
2. Securing Your Reservation
To confirm a reservation, ABISUA TRAVEL GUNA YALA requires a completed reservation form (either from our website or sent with your quote), along with the required deposit payment. It is recommended to make your reservation 30 days prior to your trip to Guna Yala – San Blas. A reservation is only accepted and finalized once the deposit is made, and from that point, a contract exists. ABISUA TRAVEL GUNA YALA reserves the right to reject any reservation at its discretion.
3. Client Data
To confirm and guarantee trip organization for Clients, the client must provide all identification details with the initial payment or no later than 30 days before the trip start date. Client details include ID or passport number, passport data copy, medical form (if applicable), full name, birthdate, international flight details, nationality, and an emergency contact or mobile number.
4. Final Payment / Additional Charges
To allow the Company to confirm and guarantee trip organization, the client must provide all client details with the final payment at the start of the tour.
Additional Charges: To avoid extra charges, book in advance and avoid last-minute hotel changes.
5. If You Change Your Reservation
An administrative fee of USD 25 per person will be charged if a confirmed reservation is changed or transferred to a different departure date or tour up to 30 days before the trip. Thereafter, all changes will be treated as cancellations, subject to the charges outlined below. If a client cannot travel and notifies us 20 days in advance under circumstances ABISUA TRAVEL GUNA YALA deems reasonable, the reservation may be transferred to another suitable person, or a refund will be issued minus 20% (10% for transfer fees and 10% for administrative costs). Refunds will be processed within 15 days.
6. Changes
The Company reserves the right to modify any facilities, services, or prices described in the brochure or website. If such a change is made, the client will be informed at the time of booking or when the change occurs. While the Company will strive to operate all tours as advertised, reasonable itinerary changes may be made as necessary or advisable by the Company due to external factors beyond its control.
7. Cancellation Policy – Right of Withdrawal
Confirmed reservations are subject to the following cancellation terms:
- Cancellations or changes to paid reservations are subject to a 50% penalty of the total package cost, with refunds processed within 60 calendar days.
- Cancellations or changes made 8 to 1 day before the departure date are subject to a 100% penalty of the total package cost.
8. Complaints
If the client has a complaint about any tour arrangements, it is a contract condition to notify our local representative at that time. If no complaint is made at that time, ABISUA TRAVEL GUNA YALA cannot accept responsibility later. If a dispute arises with ABISUA TRAVEL GUNA YALA that cannot be resolved, please write to us within 28 days of your return, and we will investigate.
9. Travel and Cancellation Insurance
Travel insurance is highly recommended for all clients. Coverage should include personal injury, medical expenses, repatriation, evacuation, cancellation, and curtailment. The Company reserves the right to check the validity and coverage of your insurance policy and may refuse transport if coverage is insufficient. If you choose not to purchase travel insurance, you will be required to sign a waiver acknowledging your acceptance of liability for costs incurred due to cancellations or medical expenses.
10. Client Responsibility
The client agrees to accept the authority and decisions of ABISUA TRAVEL GUNA YALA employees, tour leaders, and agents during their vacation. If, in the opinion of these individuals, a client’s health or conduct at any time jeopardizes the safety, comfort, or enjoyment of the tour, they may be excluded from part or all of the tour. Clients are responsible for carrying a valid passport, visa (if required), and vaccination or negative Covid-19 certificate as required for their travel.
11. Our Responsibilities
Bookings are accepted with the understanding that clients appreciate the potential risks inherent in adventure travel and undertake the tours or expeditions voluntarily. While the Company strives to provide its services with due diligence, it does not assume liability for events beyond its control, such as force majeure, weather, or natural occurrences. The Company is not responsible for travel inconveniences, delays, or obstructions caused by these factors.
12. Child Policy
Unless otherwise specified, the maximum age for children in Guna Yala – San Blas programs is 9 years and 11 months. Children over 10 are considered adults and are subject to adult rates.
13. Last-Minute Reservations
If the client has a complaint regarding any tour arrangements, it is a contract condition to inform our local representative at that time. Failure to do so prevents the Company from investigating and rectifying the issue.
14. Image Use
I hereby authorize ABISUA TRAVEL GUNA YALA to use my image for the dissemination, reproduction, and distribution of media related to the Tour / Stay event. This authorization covers any media format, social networks, and any other distribution channels now and in the future, without expecting any compensation.
By signing below, I declare that I have read, understood, and accepted the Terms and Conditions, as well as the conditions stated on the Company’s website or provided brochure/form.
